FMLA Overview

The Family and Medical Leave Act (FMLA) is a federal law that provides for an unpaid leave of absence for up to 12 weeks during any 12-month period if you experience one of these events:

  • birth or adoption of a child or placement of a foster child in your home;
  • serious health condition affecting your child, spouse, or parent (not including parents-in-law); or
  • serious health condition that makes you unable to perform your job.

Who is Eligible

You are eligible for FMLA leave if you are an active full-time or part-time employee who has worked for Alcoa or a participating subsidiary for at least 12 months. In addition, you must have worked at least 1,250 hours during the calendar year prior to the year in which the leave begins.

When Leave May Be Taken

Leave for birth, adoption or foster care placement must be taken within 12 months of the birth or placement of the child.

Leave for serious health condition may be taken:

  • in one period up to 12 consecutive weeks; or
  • on an intermittent or reduced schedule, if medically necessary, up to the 12-week limit.

You may also take an intermittent leave for birth, placement for adoption, or foster care of a child. In these cases, you'll need your supervisor's approval. If you need to take an intermittent or reduced schedule leave, you may be transferred temporarily to an alternate position, provided that the position has equivalent pay and benefits and better accomodates your schedule.

Using Paid Time

Generally, FMLA leave is unpaid. However, the company may require that you use your accrued vacation and/or your paid disability benefits before taking an unpaid family or medical leave. Any paid time used will offset the 12 weeks of total FMLA leave. Check with your human resources representative about your location's policy.
